SC transfers the Reddy murder case from AP

NEW DELHI, NOV 29 : The Supreme Court noted on Tuesday that “it is a fit case for transfer to a state other than AP” and moved the trial for the murder of former Andhra Pradesh Minister Y S Vivekananda Reddy from Andhra Pradesh to the Special CBI Court in Hyderabad.

The Bench headed by Justice M R Shah declared, “We approve the petitioner’s (Dr. Suneetha Narreddy) request that the case be transferred.

Dr. Suneetha has filed a petition with the supreme court asking for a thorough probe into the death of her father, former member of parliament Vivekananda Reddy, from the CBI special court in Hyderabad to the CBI special court in Andhra Pradesh.

The Supreme Court ordered that the CBI “would have to conclude the inquiry on the bigger conspiracy at the earliest independently and impartial manner.”

The Bench ruled that it was impossible to dismiss the petitioner’s concerns that there might not be a fair trial or that a bigger conspiracy existed. A fundamental right of the petitioner is to get justice.

“This is a case where a state other than Andhra Pradesh should take over because justice must not only be done, but also be perceived to be done. Criminal justice will be compromised if a criminal trial is slanted “The judge stated.

It was suggested that the case be moved to the CBI Special Court in Hyderabad for the convenience of the witnesses. There will be a transfer of the entire chargesheet and supplemental chargesheet.

The Central Bureau of Investigation will look into the FIR regarding the bigger conspiracy and the destruction of evidence.

The court ruled that the CBI’s inquiry “would have to be conducted in a fair and unbiased manner.”

Additionally, the petitioner requested that all witnesses get police protection and that the case’s investigation and trial go quickly and efficiently.

Vivekananda Reddy was the uncle of the current chief minister, Y S Jaganmohan Reddy, and the brother of the former chief minister of Andhra Pradesh, Y S R Reddy.

Dr. Suneetha stated in her appeal that the inquiry had not advanced even three and a half years after the murder.(PHN)
