A BJP MLA submits a caveat in the Supreme Court in the “Modi” surname dispute against Rahul Gandhi.

New Delhi, July 12 : BJP MLA Purnesh Modi, the complainant in the defamation case against Congress leader Rahul Gandhi in Gujarat, has filed a caveat in the Supreme Court in connection with the Gujarat High Court judgment refusing to stay his conviction in the case.The caveat was filed in the Supreme Court by Modi, on the same day – July 7 – the Gujarat High Court pronounced its judgment in the ‘Modi’ surname remark case.A caveat is a legal document filed by a party to a case, informing the court that the opposing aggrieved party, who has not succeeded in the lower court may file a case against them. Thereby the caveator requested the court to hear both sides before passing any order in case.In March, a magisterial court in Surat sentenced Gandhi to two years of imprisonment for his “Modi surname” remarks ahead of 2019 Lok Sabha elections. Speaking at a rally in Kolar, Rahul Gandhi had said: “How come all thieves have Modi surname in common.”On March 24, the Congress leader was sentenced to two years of imprisonment which disqualified him as an MP under the rigours of the Representation of People Act.Gandhi moved an appeal against the judgement in a sessions court in Surat, and also sought a stay on the conviction. The sessions court gave him bail but turned down his application for a stay on the conviction.He then knocked on the doors of the Gujarat High Court, but failed to get any relief.So far, Rahul has not filed any appeal in the top court challenging the lower court order.(UNI)
