Extending the interim bail for one of the accused in the Chhatrasal Stadium murder case

New Delhi, May, 16 : A Delhi Court on Tuesday extended the interim bail of one of the accused arrested along with olympian wrestler Sushil Kumar in junior wrestler Sagar Dhankar murder case at Chhatrasal stadium on the night of May 4, 2021.
Rahul Kumar, one of the accused, moved an application U/s. 439 Cr. P. C for extending the interim bail by submitting that vide order dated April 28. the court granted interim bail to the accused for one week on the ground that his father is suffering from carcinoma and was admitted in hospital.
It was further submitted that the mother of the applicant/accused is also suffering from old aged ailments and there is no one in the family of the applicant/accused to look after his ailing father as his brother has been living separately from his parents for the last seven years.
The counsel for the accused prayed that the interim bail of the accused be extended on the ground stated in the application.
Additional Public Prosecutor for the state strongly opposed the bail application and submitted that the allegations against the applicant/accused are serious in nature. It is further submitted that this Hon’ble Court has already extended the interim bail of applicant on humanitarian grounds till today i.e. 16.05.2023.
On May 12 the court directed the IO to furnish the family details of the accused and as per the report another brother of the applicant is living separately just near the house of his parents and two real brother of his father are also residing in the same vicinity. It is further submitted that all the family members of the accused are available for taking care of the father of the applicant. It is prayed that the application be dismissed.
Counsel for the accused submitted that presence of applicant/accused is required for taking care of his father as his brother and
brothers of his father residing separately. It is further submitted that interim bail of applicant/accused may be extended to the applicant/accused on humanitarian ground and he will be surrendered after the expiry of the extension of interim bail before the concerned Jail Superintendent.
