Bengal Guv returns file to government seeking constitutional adherence in summon assembly
Kolkata, Feb 19 : West Bengal governor Jagdeep Dhankar on Saturday said he sent back a file to the government, which was seeking his order to summon the West Bengal Legislative Assembly at the recommendation of Chief Minster Mamata Banerjee on March 7, 2022 at 2 pm. He said the government file he received on February 17 had the endorsement of the chief minster and it was not a cabinet decision. ” Constitutions permit the governor to summon the house only on the recommendation of the cabinet decision under the constitution, which is spelled out and also laid down the procedures in the rules of business. However, the government file on February 17 seeking summoning the assembly on March 7 was only the endorsement of the chief minister. There was no cabinet decision. In that respect I had only one option to send back the file to the government for compliance of the constitutional procedures and whenever it will be send back to me, the matter will be considered accordingly,” said the governor. ” Under article 163 Constitution Council of Ministers with CM as head is to “aid & advise Governor in exercise of his functions”.
